Why MiniMax H3’s Open-Weight License Excludes the U.S., EU, UK, and South Korea

Introduction

MiniMax has released the weights of its new H3 multimodal video model, but the release comes with an unusually clear geographic boundary.

Under the MiniMax H3 Community License Agreement, the default license applies worldwide except in:

• The United States.
• The European Union.
• The United Kingdom.
• South Korea.

That restriction quickly triggered criticism from developers who expected an open-weight release to be usable wherever the repository could be accessed.

The headline version of the controversy is that MiniMax “open-sourced H3 but blocked Americans.” The actual situation is more precise.

MiniMax has made model weights publicly available through Hugging Face, but it has not granted people and organizations in the four excluded territories the same automatic rights to run, modify, distribute, display, or deploy those weights. Organizations in those regions can apply for a separate formal license.

For the United States, MiniMax’s developer-relations lead Ryan Lee directly linked the restriction to the company’s ongoing copyright lawsuit with Disney, Universal, and Warner Bros. Discovery over its Hailuo AI video-generation service.

For the European Union, United Kingdom, and South Korea, MiniMax cites the changing regulatory environment around synthetic video, likeness generation, copyright, content safety, and responsible deployment.

This is therefore better understood as a risk-management decision expressed through a model license—not a technical block built into the weights.

MiniMax H3 Is an Open-Weight Video Model, Not a Permissively Open-Source Release

The distinction between open source and open weights matters here.

MiniMax H3’s model files are publicly hosted, and the company provides documentation for local deployment. However, access to the files does not mean users receive unrestricted rights.

The H3 Community License includes:

• Geographic restrictions.
• Commercial authorization requirements.
• Mandatory product attribution.
• Downstream user restrictions.
• Limits on using outputs to improve other AI models.
• An acceptable-use policy.
• Termination and indemnification provisions.

That is not equivalent to a permissive software license such as MIT or Apache 2.0.

It is also not an Open Source Initiative-approved license.

A more accurate description is:

MiniMax H3 is a publicly released, open-weight model governed by a territory-limited community license.

The AIBase article uses “open source” in the broader industry sense. For legal and deployment decisions, developers should use the narrower and more accurate term.

What MiniMax H3 Can Do

The licensing controversy surrounds a technically ambitious model.

MiniMax describes H3 as a general-purpose, omni-modal generative system that can understand combinations of:

• Text.
• Images.
• Video.
• Audio.

It can generate video with synchronized native stereo audio.

The official model card lists the following output capabilities:

H3 supports several generation modes, including:

• Text-to-audio-video.
• First-frame image-to-video.
• Last-frame image-to-video.
• First-and-last-frame video.
• Reference-based generation using images, video, and audio.

The model can use up to nine reference images, three video clips, and three audio clips within the limits described in the official model card.

AIBase characterizes its quality as competitive with ByteDance’s Seedance. MiniMax’s official materials position H3 as a next-generation general-purpose video system, but the “comparable to Seedance” claim should be treated as an editorial or benchmark interpretation rather than a universally established ranking.

The Public Weights Are Only Part of the Full H3 System

MiniMax describes H3 as a three-part system:

1. H3-Context-IR
2. H3-Base
3. H3-Regenerate-2K

H3-Context-IR

This hosted preprocessing and orchestration layer interprets free-form combinations of text, images, audio, and reference video.

It converts the user’s material into a structured intermediate representation that H3-Base can use more effectively.

MiniMax says this component relies on several hosted models and services. It is not included in the initial open-weight release.

Developers can use the official API or build their own context-processing workflow from MiniMax’s prompting guidance.

H3-Base

This is the main open-weight audio-video generation model.

It produces 768p video and audio from the structured context.

The official release includes separate checkpoints for:

• First/last-frame generation.
• Multimodal reference generation.

H3-Regenerate-2K

This component takes the 768p result and the original context, then regenerates the video at 2K resolution.

MiniMax says it uses the base model’s generative ability rather than a conventional standalone super-resolution model.

This component is also not yet open-weight.

The company says it plans to release it when ready, while providing an API for the current full 2K workflow.

Sparse Attention Is Also Not Included Yet

H3 was trained with native sparse attention to reduce the cost of long multimodal sequences.

The initial open-weight release provides full-attention inference. MiniMax says the sparse-attention implementation will come in a future update.

The practical conclusion is that the published weights are substantial, but they do not reproduce every component of the hosted H3 product by themselves.

The License Excludes Four Major Markets

The H3 license defines its Applicable Territory as the world excluding four regions.

The license says the granted rights apply solely within the Applicable Territory.

Those rights include:

• Using the model.
• Reproducing it.
• Modifying it.
• Creating derivatives.
• Running it.
• Displaying it.
• Distributing it.

The agreement also says H3 works and their outputs or results may not be used, reproduced, modified, distributed, or displayed outside the Applicable Territory under the default license.

This is broader than a simple ban on commercial deployment.

It means people in an excluded territory should not assume that a technically successful download gives them authorization to run the model.

Publicly Reachable Does Not Mean Legally Licensed

Hugging Face repositories are commonly accessible through a browser or command-line tool.

A territorial license does not necessarily make the underlying files technically invisible.

This creates an important distinction:

The AIBase phrase “even downloading became a luxury” captures developer frustration, but the central restriction is legal authorization, not necessarily a geographic download firewall.

Anyone making a real deployment decision should review the current license and obtain legal advice rather than relying on repository availability.

Why the United States Is Excluded

Ryan Lee, MiniMax’s developer-relations lead, gave a direct explanation.

He said:

“This regional carve-out stems from our ongoing generative video copyright litigation with major Hollywood studios.”

MiniMax’s formal license FAQ gives a broader version of the same explanation.

It says the United States has a rapidly changing AI regulatory environment and that MiniMax is involved in ongoing copyright proceedings specifically concerning generative video AI.

The company’s position is therefore explicit: the U.S. exclusion is connected to active litigation and the difficulty of controlling compliance after weights leave MiniMax’s infrastructure.

The Hollywood Lawsuit Against MiniMax

Disney, Comcast-owned Universal, and Warner Bros. Discovery filed their lawsuit in September 2025 in the U.S. District Court for the Central District of California.

The case is:

Disney Enterprises, Inc. et al. v. MiniMax et al.
Case No. 2:25-cv-08768

The studios allege that MiniMax’s Hailuo AI service:

• Used copyrighted material without authorization during model development.
• Generated recognizable versions of protected characters.
• Distributed downloadable images and videos featuring those characters.
• Used famous characters in marketing.
• Failed to implement adequate copyright safeguards.
• Encouraged or contributed to infringement.

The complaint references characters and franchises associated with:

• Marvel.
• Star Wars.
• Minions.
• Wonder Woman.
• Other major studio properties.

The plaintiffs also objected to MiniMax marketing Hailuo AI with language equivalent to having a “Hollywood studio in your pocket.”

These are allegations in an active lawsuit. They have not been finally proven at trial.

The Court Refused to Dismiss the Case

MiniMax asked the federal court to dismiss the case.

Among other arguments, it challenged whether a U.S. court had jurisdiction over a company based outside the United States and whether the studios had adequately stated copyright claims.

On May 22, 2026, the court denied the motion to dismiss.

The judge concluded that the studios had plausibly alleged infringement and that the case could proceed in the United States.

This ruling is important, but it is frequently overstated.

A denial of a motion to dismiss means:

• The complaint contains legally sufficient allegations to continue.
• The court found an adequate basis for jurisdiction at this stage.
• The parties can proceed into later litigation phases.

It does not mean:

• MiniMax has been finally found liable.
• Every allegation is true.
• Damages have been awarded.
• The court has decided whether all training uses were infringing.
• The case is over.

The litigation remains ongoing.

Why a Lawsuit About Hailuo Affects H3’s License

H3 is a newer model than the Hailuo system at the center of the complaint.

The legal risk still carries over.

An open-weight video model creates several problems that a hosted product can partially control.

Once weights are distributed, independent users can:

• Remove safety filters.
• Fine-tune the model.
• Change preprocessing.
• Host their own service.
• Generate content outside MiniMax’s moderation system.
• Redistribute derivatives.
• Operate in ways MiniMax cannot continuously monitor.

If users generate recognizable copyrighted characters or other restricted content, plaintiffs could argue that MiniMax knowingly distributed a system that facilitates the disputed conduct.

Whether that legal theory would ultimately succeed is a question for the courts.

From MiniMax’s perspective, the active case gives the company a reason to limit the default U.S. license until it can require stronger controls from each authorized deployer.

Why the EU, UK, and South Korea Are Also Excluded

The Hollywood lawsuit explains the United States.

MiniMax gives a different, broader explanation for the other three territories.

The company says rules for generative video are still evolving around:

• Likeness generation.
• Copyright.
• Deepfakes and synthetic media.
• Content labeling.
• Safety.
• Responsible deployment.
• Platform accountability.

European Union

MiniMax points to the implementation of the EU AI Act and unresolved practical requirements for video- and likeness-generating models.

United Kingdom

The company says regulatory uncertainty remains around AI-generated content and video-generation systems.

South Korea

MiniMax similarly cites changing rules and compliance expectations for synthetic content.

The company’s official position is that these regions are “not yet,” rather than “never.”

It says it will continue reviewing local laws and may expand the default license scope.

The API Remains Globally Available

The regional restriction applies to the open-weight community license.

MiniMax says the hosted H3 API is available globally.

The company explains the difference through operational control.

With an API, MiniMax controls the serving infrastructure and can apply:

• Content moderation.
• Copyright safeguards.
• Protection against misuse involving minors.
• Safety filters.
• Logging.
• Account controls.
• Compliance processes.
• Regional product policies.

With local weights, the user controls the system.

MiniMax cannot guarantee that filters remain enabled or that downstream deployment complies with local law.

For many developers in an excluded territory, the hosted API is therefore the simplest authorized route.

Organizations Can Apply for a Formal License

MiniMax says organizations in the United States, European Union, United Kingdom, and South Korea can submit a formal licensing request.

The company says approval may be granted after it reviews the intended deployment and confirms that the applicant will implement suitable compliance controls.

Possible controls may include:

• Copyright filters.
• Content moderation.
• Restricted-character detection.
• User terms.
• Age-related safeguards.
• Audit logging.
• Reporting procedures.
• Takedown processes.
• Regional legal compliance.
• Limits on redistribution.

MiniMax does not promise that every application will be accepted.

The exact review criteria, timeline, cost, and contractual terms may depend on the deployment.

Applicants should use the official form linked from the H3 license FAQ or contact MiniMax through its published licensing channels.

Other Important Commercial Terms

The geographic carve-out is the most visible part of the license, but it is not the only material condition.

Companies Above $20 Million in Annual Revenue Need Separate Authorization

If a commercial product or service using H3 generates more than $20 million in annual revenue, the license requires prior written authorization from MiniMax.

The threshold applies to the commercial product or service using the model, not necessarily only to revenue directly charged for each generated video.

Organizations near the threshold should obtain legal advice and clarification from MiniMax.

Commercial Products Must Display “MiniMax H3”

The agreement requires commercial products or services using H3 to display “MiniMax H3” prominently in the user interface.

The license also encourages:

• A “Powered by MiniMax H3” notice.
• AI-generation identifiers on output files.
• A public technical blog or statement describing the deployment experience.

Some of these items are encouraged, while the prominent commercial display requirement is mandatory.

Downstream Users Must Be Bound by Restrictions

Before offering access to an H3-based product or hosted service, the licensee must bind recipients to enforceable terms at least as protective as the H3 use restrictions and acceptable-use policy.

This means a developer cannot simply put the model behind an unrestricted public endpoint.

H3 Outputs Cannot Be Used to Improve Unrelated AI Models

The license prohibits using H3 works, outputs, or results to improve another AI model, except H3 itself or an H3 model derivative.

This affects:

• Synthetic-data generation.
• Distillation into unrelated models.
• Training competitive video systems from H3 outputs.
• Some evaluation-to-training pipelines.

Litigation Can Terminate the License

The agreement contains an intellectual-property retaliation clause.

If a licensee brings certain claims alleging that H3 materials or outputs infringe the licensee’s rights, the granted licenses terminate as of the filing date.

Users Bear Output Responsibility

MiniMax says it claims no rights over generated outputs.

At the same time, users are fully responsible for those outputs and their subsequent use.

Ownership and legal safety are not the same thing.

A user may control an output under the contract while still facing copyright, publicity-right, privacy, defamation, or other legal claims.

The Model’s Safety Layer Does Not Replace the License

The official model card says uploaded text, images, and video, along with enhanced prompts, may undergo automated moderation in MiniMax’s hosted workflow.

Material suspected of being:

• Illegal.
• Pornographic.
• Infringing.
• Otherwise unsafe.

may be blocked.

MiniMax also warns that filters can produce false positives and false negatives.

More importantly, the model card says these guardrails do not remove the licensee’s legal obligations.

A content filter is not a legal guarantee.

Developers remain responsible for:

• The prompts users submit.
• Reference media.
• Generated outputs.
• Distribution.
• Commercial use.
• Regional availability.
• Compliance with the H3 license.
• Compliance with local law.

The Architecture Helps Explain the Compliance Concern

H3 is not only a text-to-video checkpoint.

Its design allows complex multimodal references and synchronized audio-video generation.

The H3-Base architecture includes:

• A Qwen3-VL-32B-based encoder.
• Visual and audio VAEs.
• A 33B-parameter omni-modal Transformer.
• Joint prediction of video and stereo-audio latents.
• Multimodal positional encoding across time and space.

Reference inputs can include several images, videos, and audio clips.

That versatility is useful for creative work, but it also increases the risk of:

• Character imitation.
• Voice or likeness replication.
• Recreating protected scenes.
• Style and asset misuse.
• Synthetic media involving real people.
• Removing evidence of how a result was produced.

Those risks are part of why open-weight video licenses are often more restrictive than text-model licenses.

Is the Restriction Geopolitical?

The AIBase article argues that the U.S. exclusion is not a hidden geopolitical blockade.

MiniMax’s own public explanation supports a legal and regulatory interpretation.

Ryan Lee directly cites the Hollywood litigation for the U.S. carve-out, while the license FAQ cites evolving video-AI regulations in the EU, UK, and South Korea.

Still, it is difficult for outside observers to prove that any company decision has only one motivation.

The most defensible statement is:

MiniMax publicly attributes the exclusions to litigation and regulatory risk, and there is direct documentary evidence supporting that explanation.

There is no need to invent a geopolitical theory when the company is already facing an active U.S. lawsuit and has written the territorial restrictions into a detailed compliance-focused license.

What Developers Should Do Before Using H3

Step 1: Identify the Deployment Territory

Determine where:

• The developer is based.
• The model will run.
• End users will access it.
• Outputs will be generated and displayed.
• Hosted infrastructure is located.

A globally accessible service may implicate more than one territory.

Step 2: Read the Current License

Do not rely on summaries alone.

MiniMax says it may update its acceptable-use policy, and regional availability may change.

Record the license version used for the deployment.

Step 3: Decide Between API and Local Weights

In an excluded territory, the official API may be available even when local deployment is not authorized by default.

The API can also reduce the compliance burden because MiniMax operates the core moderation layer.

Step 4: Apply for a License When Necessary

Organizations seeking local deployment in an excluded territory should use MiniMax’s formal licensing process before running the model.

Step 5: Review the Commercial Threshold

Products exceeding $20 million in annual revenue require separate prior written authorization.

Step 6: Build Real Guardrails

Depending on the product, controls may need to cover:

• Copyrighted characters.
• Reference-image permissions.
• Face and voice consent.
• Minors.
• Adult content.
• Illegal content.
• Output labeling.
• User reporting.
• Repeat offenders.
• Audit logs.
• Takedown requests.

Step 7: Preserve Attribution and Notices

Commercial interfaces and redistributed materials must follow the license’s attribution and notice requirements.

Step 8: Review Training and Distillation Pipelines

Do not assume H3 outputs can be used freely as synthetic training data for unrelated models.

Step 9: Obtain Legal Advice for Production Use

This article is informational, not legal advice.

The combination of territory restrictions, copyright litigation, video-generation risk, and downstream-user terms makes professional review appropriate for commercial deployment.

What Is Confirmed and What Is Still Alleged

常见问题

Is MiniMax H3 available in the United States?

The hosted MiniMax API is described by the company as globally available. Local use of the public H3 weights in the United States is not authorized by the default community license, although organizations can apply for a separate license.

Which territories are excluded from the H3 community license?

The excluded territories are the United States, European Union, United Kingdom, and South Korea. The license defines the rest of the world as the Applicable Territory, subject to local law and all other license terms.

Why did MiniMax exclude the United States?

MiniMax developer-relations lead Ryan Lee said the carve-out stems from ongoing generative-video copyright litigation with major Hollywood studios. MiniMax says separately licensed U.S. deployments must implement robust legal, compliance, and safety controls.

Why are the EU, UK, and South Korea excluded?

MiniMax cites evolving rules around video generation, likenesses, copyright, content safety, and responsible deployment. The company describes the restrictions as temporary and says it will continue reviewing local requirements.

Is MiniMax H3 really open source?

Its weights are public, but the license contains geographic, commercial, attribution, use, and redistribution restrictions. “Open-weight under a community license” is more accurate than “open source” in the conventional software sense.

Did a U.S. court rule that MiniMax infringed Disney’s copyright?

No final infringement judgment has been issued in the sources reviewed for this article. The court denied MiniMax’s motion to dismiss, which means the studios’ claims were plausible enough to proceed.

Can an excluded-region company request local deployment rights?

Yes. MiniMax says organizations can submit a formal application and may receive authorization after demonstrating suitable compliance controls and guardrails.

Can I use H3 outputs to train another video model?

The community license prohibits using H3 works, outputs, or results to improve unrelated AI models. It allows development of H3 model derivatives within the agreement, but teams should review the precise terms before building a synthetic-data or distillation pipeline.

Summary

MiniMax H3 is a major public-weight release, but it is not geographically unrestricted. Its community license excludes the United States, European Union, United Kingdom, and South Korea, while allowing organizations in those regions to seek separate authorization.

For the United States, MiniMax directly attributes the restriction to its ongoing copyright lawsuit with Disney, Universal, and Warner Bros. Discovery. The court has allowed that case to proceed, but it has not issued a final ruling that MiniMax is liable.

The EU, UK, and South Korean exclusions are tied to broader regulatory uncertainty around generative video, likenesses, copyright, content safety, and open-weight deployment. MiniMax keeps its hosted API globally available because it can retain safety and compliance controls on its own infrastructure.

The central lesson is that public model weights and open deployment rights are not the same thing: H3 can be visible to the world while its license still decides where and how it may legally be used.
